How to Handle a Local Law 62 Violation (LL62/91)

LL62/91 is the violation-number code for Local Law 62 of 1991. The types page calls it boiler. On the boiler resolving page, a missed periodic inspection report sits under this law, marked LBLVIO or HBLVIO. That is the filing this code names. B, BDM, and BMD are other boiler codes. The types page gives those three the meaning boiler as well, but it does not define them as Local Law 62. This page is not that other article.

Read the notice

Confirm the number contains LL62/91, or that the paper cites LBLVIO or HBLVIO for a missed cycle report. An asterisk means the types page marks the item dismissed. A boiler removal, or a condition on the boiler itself, can be a different paper. Read the words, not only the word boiler.

Older summonses say ECB. Current pages call that hearing path an OATH summons. OATH holds the hearing. OATH is not part of the Department of Buildings and does not issue the summons. The Department cites failure to file a required annual boiler report as a DOB violation that can include a fine. A DOB violation is an order to correct, and there is no court appearance. If your paper is a summons, it will show a hearing date. Use that date.

If a class is printed, Class 1 is immediately hazardous, Class 2 is major, and Class 3 is lesser. The class is severity. It is not part of LL62/91. The code does not set it. Unless OATH dismisses a summons, the condition must still be corrected and accepted. Paying the penalty does not close the Department record.

What the city is requiring

The remedy stated for the missed periodic inspection report is proof of the report for the cycle, or payment of the civil penalties plus a current report in DOB NOW: Safety. The page points to a civil-penalty chart and does not print the amounts. Do not guess a dollar figure from the code.

The Boiler Unit oversees installation, operational safety, and inspection compliance for low-pressure and high-pressure boilers. The public pages do not spell LBLVIO and HBLVIO out as separate violation types. They use both marks for this missed-report filing. The report you need is the one for the cycle the notice names.

Other boiler work the unit describes, including a removal notification, is not what LL62/91 names. Do not file a removal form in place of the cycle report unless the notice is about a removal. The classification table also lists failure to maintain the building in a code-compliant manner for the boiler as service equipment. That is a maintenance charge. It applies only if your paper states it.
