How to Handle a Local Law 10 of 1980 Violation (LL10/80)

LL10/80 is the violation-number code for Local Law 10 of 1980. The types page labels it as facade, borough office. That is the whole label. The page does not list cycles, report names, or penalties under LL10/80. The notice states the condition. Local Law 11 of 1998, code LL11/98, is the later facade code. Do not treat the two numbers as the same filing.

Read the notice

Confirm the number contains LL10/80, including the year mark. LL10/81 is Local Law 10 of 1981, and that code is an elevator safety test, not a facade. An asterisk means the types page marks the item dismissed.

Older papers say ECB. Current pages call that hearing path an OATH summons. OATH holds the hearing. OATH is not part of the Department of Buildings and does not issue the summons. A DOB violation is a notice that the property is out of compliance, plus an order to correct, and there is no court appearance. A facade file can be either kind of paper. Read yours.

If a class is printed, Class 1 is immediately hazardous, Class 2 is major, and Class 3 is lesser. The class is severity. It is not a subtype of LL10/80. The code does not set the class. On a summons, use the hearing date and any cure date on that summons. Paying a penalty does not close the Department record.

What the city is requiring

Follow the condition on the notice. The types page does not state a correction method for the 1980 code. Current facade rules are a different description. Owners of buildings higher than six stories must have exterior walls and appurtenances inspected every five years and must file a technical facade report. A Department-approved Qualified Exterior Wall Inspector files that report as Safe, Safe With a Repair and Maintenance Program, or Unsafe. Those are the current facade-compliance rules. They are not printed on the LL10/80 label. Use them only when your paper, or the office handling it, is applying that program.

If the paper is the older borough-office file, the borough office named on the notice is the place the order points. Do not substitute a form number, a shed rule, or a penalty from the current facade fee page unless the notice cites it. Public protection, amended reports, and extension filings belong to the facade program the current pages describe. They are not automatic LL10/80 steps.

What S & M Expediting handles

S & M Expediting researches the LL10/80 paper and whether it is a DOB violation or an OATH summons. We prepare and file the certificate of correction and the related Department filings, and we follow them. When the paper is a summons, we can appear at the OATH hearing.

S & M Expediting is a Class 2 filing representative. We will work with the facade contractor you have, or if not, we will recommend one from our network. See our DOB violation removal service.

Who does the corrective work

A Qualified Exterior Wall Inspector files a current technical facade report when that is what the city is asking for. A licensed contractor does the repair the report or the notice requires. We will work with the facade contractor you have, or if not, we will recommend one from our network.
