How to Handle a Local Law 10 of 1981 Violation (LL10/81)

LL10/81 is the violation-number code for Local Law 10 of 1981. The types page calls it an elevator safety test. On the elevator resolving pages, failure to file an inspection and test report is tied to this law. The notice states which report or cycle is open. E is the general elevator code. EIT is a separate elevator safety test mark. Neither one replaces LL10/81.

Read the notice

Confirm the number contains LL10/81. LL10/80 is Local Law 10 of 1980, a facade label kept by the borough office, not an elevator test. An asterisk means the types page marks the item dismissed.

Older summonses say ECB. Current pages call that hearing path an OATH summons. OATH holds the hearing. OATH is not part of the Department of Buildings and does not issue the summons. Failure to file a required annual elevator report is one of the DOB violations the Department says can include a fine. A DOB violation has no court appearance. If your paper is a summons instead, it will show a hearing path. Read the document.

If a class is printed, Class 1 is immediately hazardous, Class 2 is major, and Class 3 is lesser. The class is severity, not part of the LL10/81 label. On a summons, read the hearing date and any cure date. Unless OATH dismisses the summons, the condition must still be corrected and a certificate of correction accepted. Paying the penalty does not close the Department record.

What the city is requiring

The remedy stated for failure to file an inspection and test report under Local Law 10 of 1981 is proof of the filed report, or payment of the civil penalties plus a current report. The resolving page names two payment types: Failure to File, and Failure to File an Affirmation of Correction. It does not, on that description, print the dollar amounts. The compliance page has late-filing figures that differ for residential and non-residential devices and for Category 1 versus Category 5. Those figures are not reprinted here.

The same elevator pages describe the tests the reports cover. Elevators must be inspected and tested twice a year. The periodic inspection is a visual inspection. Category 1 is an annual no-load safety test. Category 5 is a rated-load test on a five-year cycle. Use the test the notice names. Do not pick a category because the code says safety test.

Other elevator clocks, including defect corrections and failure-to-maintain cases, are described on the elevator pages for those charges. They are not the Local Law 10 of 1981 filing remedy above. Use them only when the notice is that other charge.
